{"id":56,"date":"2005-11-09T16:39:17","date_gmt":"2005-11-09T16:39:17","guid":{"rendered":"http:\/\/pgregg.com\/wp\/2005\/11\/freedom-of-information-request-2-detini-the-appeal\/"},"modified":"2005-11-09T16:39:17","modified_gmt":"2005-11-09T16:39:17","slug":"freedom-of-information-request-2-detini-the-appeal","status":"publish","type":"post","link":"https:\/\/blog.pgregg.com\/blog\/2005\/11\/freedom-of-information-request-2-detini-the-appeal\/","title":{"rendered":"Freedom of Information, Request #2 &#8211; DETINI &#8211; The appeal."},"content":{"rendered":"<p>Today I appealed against the DETI NI&#8217;s <a href=\"http:\/\/www.pgregg.com\/forums\/viewtopic.php?tid=51\" rel=\"nofollow\" target=\"_blank\">refusal<\/a> to grant my <a href=\"http:\/\/www.pgregg.com\/forums\/viewtopic.php?tid=50\" rel=\"nofollow\" target=\"_blank\">FOI request for details of the BT 100% broadband contract<\/a>.<\/p>\n<p>Here is the content of the appeal:<\/p>\n<p><\/span><\/p>\n<table style=\"width: 95%\" align=\"center\" cellspacing=\"4\" cellpadding=\"6\">\n<tr>\n<td class=\"punquote\"><span class=\"puntext\"><br \/>Subject: Appeal against decision on FOl 062<\/p>\n<p>Dear Trevor,<\/p>\n<p>Thank you for your letter of 2 November 2005.&nbsp; It has been a number of<br \/>years since we last spoke. I hope all is well with you.<\/p>\n<p>I write to appeal your decision to withhold full responses on questions 1<br \/>and 3 of my request. Please understand this email as an official request for<br \/>an Internal Review of your decision.<\/p>\n<p>I do not believe that DETINI decision to withhold is either within the<br \/>letter nor the spirit of the Law (FOI Act 2000).<\/p>\n<p>Further, Information Commissioner guidance on the law which has been available<br \/>to Public bodies for some time (well before your signing of the March 2004<br \/>contract with BT) specifically on confidentiality clauses as also been<br \/>ignored.<br \/>A blanket confidentiality clause does not absolve the department of<br \/>its statutory obligations and the Information Commissioner has stated<br \/>in the guidance that he would look unfavourably on such blanket clauses.<\/p>\n<p>You should also be aware that general confidentiality and the excuse of<br \/>&quot;likely to prejudice BT&#8217;s commercial interests&quot; may not apply for companies<br \/>who are regarded as a Monopoly.&nbsp; BT has the country&#8217;s largest recognised<br \/>monopoly.&nbsp; The Information Commissioner has also stated this consideration<br \/>in the published Awareness Guidelines.<br \/>I do not believe that BT, as a monopoly, can possibly be commercially<br \/>damaged by the release of any information.<\/p>\n<p>Finally, I do not see any evidence of the Public Interest Test which I<br \/>believe you are obligated to complete.&nbsp; This information has undoubted<br \/>public interest.&nbsp; The department has spent tax payers money on a contract<br \/>with BT.&nbsp; I quote from your department&#8217;s own press release:<br \/>&quot;This vitally important contract will deliver the Government&#8217;s broadband<br \/>vision of a fully connected Northern Ireland. In turn it will help<br \/>make Northern Ireland more competitive.&quot; &#8211; Ian Pearson, MP<br \/>&quot;This will ensure that Northern Ireland is a seriously attractive area<br \/>for existing company expansion and new inward investment.&quot; &#8211; Bill Murphy, BT<br \/>&quot;Broadband access to all rural areas will be a tremendous boost. Many rural<br \/>communities have already been campaigning to bring Broadband to their<br \/>locality. This demonstrates the demand for the service and having it<br \/>available to every household in Northern Ireland will ensure that a<br \/>rural \/urban divide does not open up.&quot; &#8211; John Gilliland, UFU<br \/>&nbsp; <a href=\"http:\/\/www.detini.gov.uk\/cgi-bin\/morenews?utilid=433\" rel=\"nofollow\" target=\"_blank\">http:\/\/www.detini.gov.uk\/cgi-bin\/morenews?utilid=433<\/a><\/p>\n<p>The department itself recognises this contract of vital importance to<br \/>the Northern Ireland economy.<\/p>\n<p>Finally, I note that the department has not yet updated the PDF document<br \/>on how to make a FOI request to include the correct email address. I was<br \/>assured at the time that this would be taken care of immediately (during<br \/>a telephone call from Ian Boyd).<br \/>&#8211; <a href=\"http:\/\/www.detini.gov.uk\/cgi-bin\/downutildoc?id=853\" rel=\"nofollow\" target=\"_blank\">http:\/\/www.detini.gov.uk\/cgi-bin\/downutildoc?id=853<\/a><\/p>\n<p>I am also concerned that during the phone call from Ian Boyd that he seemed<br \/>to want to know, a) who I was, b) was I a competitor to BT, and&nbsp; c) to<br \/>what purpose I wanted the information.&nbsp; None of this information is relevant<br \/>to any FOI request.
